  2. No resolution from USDOL yet, but it sounds like one of two options are being considered that will benefit veterans who are receiving both UI and education benefits/living stipend.

    Veterans Receiving Post-9/11 Education Assistance

    Late last year, Congress passed the National Defense Authorization Act of 2016. Effective November 25, 2015, the bill made veterans receiving Post-9/11 GI education payments ineligible for unemployment benefits.  Our early instruction to staff was to continue to use our existing policy until guidance is received from the U.S. Department of Labor (USDOL).

    USDOL has not yet reached a decision as to which veterans will be impacted by the new law. It is also still working on how to identify veterans who are UI claimants, recipients of Post-9/11 education benefits, or both.

    The link below provides more detailed information. Note the last sentence of the article says “States are not required to enforce it until the new guidance from the Labor Department is released.” Based on this, ESD will continue paying unemployment benefits as if the law has not changed until such time as we receive formal guidance from USDOL.
