Santo Domingo, 5 oct (EFE).- Un tribunal dominicano autorizó que se transfiera sangre, cuantas veces sea necesaria, a la hija de una pareja de Testigos de Jehová que nació tras un parto de 7 meses y con complicaciones de salud, pese a la oposición de sus padres, informó hoy la Procuraduría General de la República (PGR).
La sentencia fue emitida por la Sala Civil del Tribunal de Niños, Niñas y Adolescentes (NNA), que acogió un recurso de amparo que en contra de la pareja presentó el fiscal titular interino de Niños, Niñas y Adolescentes de la provincia de Santiago (norte), Nelson Rodríguez González, debido a que los padres de la niña se oponían al procedimiento médico por asuntos religiosos.

De acuerdo con la PGR, la sentencia ordenó a una clínica de la provincia Santiago, donde se encuentra hospitalizada la recién nacida, “realizarle la transfusión sanguínea cuantas veces sea necesario, acorde a los protocolos médicos correspondientes”.

La decisión del tribunal es de ejecución inmediata, por lo que la niña, de 15 días nacida, diagnosticada con anemia, una trombopenia severa y un proceso bacteriano agudo severo, comenzó a recibir la transfusión de sangre, según la información.

Esta es la primera sentencia que se emite en el país en contra de una acción de esa naturaleza, precisó la PGR. EFE

Murió recién nacida hija de testigos de Jehová a la que juez ordenó transfusión de sangre

SANTO DOMINGO. Falleció la recién nacida a quien un tribunal de Santiago ordenó que se le practicara una transfusión de sangre a pesar de la oposición de sus padres que profesan la religión de los testigos de Jehová –que va en contra de este tipo de procedimiento médico-, un caso que sentaría un precedente, según consideran abogados consultados.

Conforme le fue informado a Diario Libre por fuentes ligadas al caso, la niña murió la semana pasada debido a su delicado estado de salud, que requería una transfusión de sangre inmediata.

El pasado 5 de octubre el Ministerio Público informó que logró que la Sala Civil del Tribunal de Niños, Niñas y Adolescentes en Santiago acogiera una Acción Constitucional de Amparo contra una pareja de testigos de Jehová que se negaba a que se le practicase una transfusión de sangre a su hija de 15 días de nacida en un parto prematuro, diagnosticada con anemia macrocítica normocrómica, trombopenia severa y un proceso bacteriano agudo severo.

El Ministerio Público dijo que la decisión del tribunal era de ejecución inmediata y es la primera sentencia que logra contra una acción de esa naturaleza.

Sobre la decisión del tribunal

“No deja de ser un precedente en ese tribunal, pero aun cuando se trate de una sentencia novedosa, digámoslo así, todavía no habiendo adquirido la autoridad de la cosa juzgada, no le es vinculante a ni siquiera otros tribunales que puedan conocer de casos similares”, indica Servio Tulio Castaños, vicepresidente ejecutivo de la Fundación Institucionalidad y Justicia (Finjus).

Observó que “se trata de una decisión de un tribunal de primer grado”. “Las decisiones de los tribunales de primer grado no son vinculantes, es decir solamente son vinculantes sentencias en principio que adquieran la autoridad de la cosa juzgada y en ese caso ya habría que tomar en cuenta al Tribunal Constitucional porque hay aspectos que tienen que ver ahí con el derecho a la vida y derechos fundamentales”.

“Los Testigos obedecemos el mandato bíblico de abstenernos de la sangre por respeto a Dios, quien nos dio la vida”.

En la página web oficial de los testigos de Jehová se explica que esa denominación no acepta transfusiones por “razones religiosas, más bien que médicas”. Se basan en que tanto el Antiguo como el Nuevo Testamento mandan a abstenerse de la sangre y lo sustentan en citas como Génesis 9:4, que dice: “Pero carne con su vida, que es su sangre, no comeréis”; o Deuteronomio 12:23, que dice: “Solamente que te mantengas firme en no comer sangre; porque la sangre es la vida, y no comerás la vida juntamente con su carne”.

“Los Testigos obedecemos el mandato bíblico de abstenernos de la sangre por respeto a Dios, quien nos dio la vida”, afirman. En cambio, destacan que consultan a médicos y cirujanos con experiencia en el uso de técnicas sin sangre cuando alguien se enferma o debe ser operado.

En otros países casos de testigos de Jehová y transfusiones también han llegado a los tribunales. El pasado julio, por ejemplo, medios mexicanos reportaron la decisión de un juez en Chihuahua de conceder el amparo a una mujer de esta iglesia para evitar que se transfundiera sangre a su hija de cinco años, enferma de leucemia, siempre y cuando se agotasen otros medios o tratamientos alternativos. Sin embargo, autorizó a los médicos a realizar lo pertinente para proteger la vida de la menor, incluida la transfusión sanguínea, si fuere necesario.

Para Laura Rosario Liberato, abogada asociada del Departamento de Familia de la firma Guzmán Ariza, la intervención del Estado en el caso de Santiago tuvo como objetivo “garantizar la efectiva protección del derecho a la vida de la recién nacida”.

“Es preciso destacar que sienta un criterio tendente a crear un precedente jurídico vinculante que responde a una realidad social que tanto el legislador dominicano como la Corte Interamericana de los Derechos Humanos han querido esclarecer en lo que respecta a la protección de los derechos fundamentales de los niños, sin que esto se interprete como un menoscabo de la autoridad parental más la consecución del interés superior del niño”, agregó.

El Ministerio Público indicó que la acción judicial buscaba preservar y garantizar los derechos humanos, especialmente el de la vida, como lo consigna la Constitución de la República y las leyes del país. Se reservó los datos de la familia por razones legales.

Al preguntarle a Castaños si la decisión del tribunal sentaría un precedente para futuros casos que no tengan influencia religiosa y entre en conflicto la voluntad de los padres, respondió: “Eso dependerá de cuál sea el caso, de qué se le someta al tribunal, siempre estará abierta la vía, digámoslo así, cuando se da una colisión entre derecho, ya ese tercero imparcial, que es el juez, ponderará cuál de los derechos está por encima del otro”.

While the Rothschilds were indeed influential individuals who were able to sway governments, much like present-day billionaires, the true impetus for change stems from the omnipotent forces (Satan) shaping our world. Whatever personal experiences we may have had with well-known individuals, true Christians understand that current events were foretold long ago, and nothing can prevent them from unfolding. What we are witnessing is the result of Satan's wrath upon humanity, as was predicted. A true religion will not involve itself in the politics of this world, as it is aware of the many detrimental factors associated with such engagement. It understands the true intentions of Satan for this world and wisely chooses to stay unaffected by them.
    • This idea that Satan can put Jews in power implies that God doesn't want Jews in power. But that would also imply that God only wants "Christians" including Hitler, Biden, Pol Pot, Chiang Kai-Shek, etc. 
    • @Mic Drop, I don't buy it. I watched the movie. It has all the hallmarks of the anti-semitic tropes that began to rise precipitously on social media during the last few years - pre-current-Gaza-war. And it has similarities to the same anti-semitic tropes that began to rise in Europe in the 900's to 1100's. It was back in the 500s AD/CE that many Khazars failed to take or keep land they fought for around what's now Ukraine and southern Russia. Khazars with a view to regaining power were still being driven out into the 900's. And therefore they migrated to what's now called Eastern Europe. It's also true that many of their groups converted to Judaism after settling in Eastern Europe. It's possibly also true that they could be hired as mercenaries even after their own designs on empire had dwindled.  But I think the film takes advantage of the fact that so few historical records have ever been considered reliable by the West when it comes to these regions. So it's easy to fill the vacuum with some very old antisemitic claims, fables, rumors, etc..  The mention of Eisenhower in the movie was kind of a giveaway, too. It's like, Oh NO! The United States had a Jew in power once. How on earth could THAT have happened? Could it be . . . SATAN??" Trying to tie a connection back to Babylonian Child Sacrifice Black Magick, Secret Satanism, and Baal worship has long been a trope for those who need to think that no Jews like the Rothschilds and Eisenhowers (????) etc would not have been able to get into power in otherwise "Christian" nations without help from Satan.    Does child sacrifice actually work to gain power?? Does drinking blood? Does pedophilia??? (also mentioned in the movie) Yes, it's an evil world and many people have evil ideologies based on greed and lust and ego. But how exactly does child sacrifice or pedophilia or drinking blood produce a more powerful nation or cabal of some kind? To me that's a giveaway that the authors know that the appeal will be to people who don't really care about actual historical evidence. Also, the author(s) of the video proved that they have not done much homework, but are just trying to fill that supposed knowledge gap by grasping at old paranoid and prejudicial premises. (BTW, my mother and grandmother, in 1941 and 1942, sat next to Dwight Eisenhower's mother at an assembly of Jehovah's Witnesses. The Eisenhower family had been involved in a couple of "Christian" religions and a couple of them associated with IBSA and JWs for many years.)
