Mató al ex de su pareja: lo absolvieron por legítima defensa

La Cámara Penal entendió que un herrero mató al ex de su pareja al defenderse de una agresión. El homicidio se produjo en 2013 en barrio Belgrano Oeste. La víctima fatal violó prohibición de acercamiento por violencia de género.

La Cámara Penal confirmó el dictamen de primera instancia que absolvió por legítima defensa a un herrero de 33 años, quien mató de un puntazo en el pecho a la ex pareja de su novia en medio de una pelea. El hecho ocurrió el 4 de agosto de 2013 en el frente de la vivienda de la mujer, en barrio Belgrano Oeste. El fallecido tenía prohibición de acercamiento y, ese día, cuando vio a su ex con una nueva pareja reaccionó de manera violenta lo que llevó al desenlace fatal.

Martín Américo “Japo” Prado tenía 34 años y por agosto de 2013 ya hacía tres años que estaba separado de Ileana, con quien tuvo un hijo de 15 años y una hija de 13. La mujer lo había denunciado por violencia de género, por lo que el juez de Familia había ordenado una restricción de acercamiento para Martín.

Según se desprende de la causa, allegados contaron que el hombre tenía problemas con drogas y por 2013 se había acercado al Templo de los Testigos de Jehová para tratar su adicción. En el proceso, su hermano declaró que Martín estaba mejor y que tenía la intención de recuperar a su familia.

Ileana era creyente de los Testigos de Jehová e iba todos los domingos al templo de Vélez Sarsfield y México. En ese lugar había conocido a Ramiro L. Después de una semana, Ileana le avisó a su madre que el domingo 4 de agosto de 2013 iba a presentarle a su novio.

La situación no era fácil para la mujer debido a que vivía con sus dos hijos en la misma casa que sus progenitores y su padre le había dicho que no iba a aceptar en su casa a otro hombre que no fuese Martín. A este contexto se sumó que su ex pareja vivía a dos cuadras en la casa de sus padres. El hombre también llevaba y traía a sus hijos hasta la puerta de la vivienda de su ex pareja, haciendo caso omiso a la restricción de acercamiento.

Ese domingo, Ileana estuvo con Ramiro en la reunión del centro de los Testigos de Jehová. También estaba Martín con la hija de ambos. Cuando terminó la reunión, la mujer se subió al Peugeot 504 de Ramiro, quien la llevó hasta la puerta de su vivienda de pasaje Kay al 600. Martín Prado estaba en la vereda porque había ido a dejar a su hija. Ileana bajó y su ex empezó a gritarle que no estaba de acuerdo con su relación. Dijo que no quería que Ramiro se acercara a sus hijos. La mujer contó que Martín se puso agresivo. Ileana se metió a la casa y llamó al 911 para advertir de que había violado la prohibición de acercamiento. Los gritos alertaron al papá de la mujer, quien se quedó observando la situación.

Ileana salió y Martín empezó a empujarla. Después fue hasta el 504, golpeó el capó a Ramiro. Quería que se bajara. Ramiro sólo abrió la ventanilla y en ese momento recibió un golpe en la cara. El novio de Ileana intentó calmar la situación y le pidió a Martín que hablaran bien.

En el juicio, que se sustanció por escrito, Ileana contó lo que Ramiro le había dicho: “Que no quería tener problemas y que no se iba a meter con nuestros hijos, que tenía que entender que yo tenía una nueva pareja, ya que hacía tres años que me había separado de él”.

Martín no hizo caso, siguió Ileana con su relato. Abrió la puerta del lado del conductor, Ramiro se quedó sentado y Martín empezó a pegarle. Ileana se metió para que parara y sufrió un golpe en la cara que la hizo trastabillar. Ese fue el momento en que Ramiro le dijo: “Esto no te lo voy a permitir”, y siguió el forcejeo, describió la mujer.

Ese fue el momento fatal. Según contó más tarde el acusado ante el juez cuando Martín se le abalanzó dentro del auto le ajustó la corbata. Sintió que le faltaba el aire, que se estaba ahogando. Insistió en que tenía miedo y lo había invadido el pánico: de un ojo no podía ver y pensó que se moría. Ahí fue cuando buscó el cuchillo que llevaba siempre en la palanca de cambios y dio la estocada fatal. La hoja del cuchillo de caza entró debajo de la tetilla izquierda de Martín.

Sin embargo, pese a la puñalada, Martín siguió pegándole, según el relato de Ileana, quien añadió que incluso la hija de 13 años intercedió, tras lo cual el padre cesó la agresión y en ese momento Ramiro le pegó en la cara. Martín dio unos pasos para atrás, se miró el pecho y vio que la camisa se le empezó a empapar con sangre. “¿Qué hiciste?”, le dijo Ileana a Ramiro, mientras su novio repetía: “Perdón, perdón”.

Martín se desvaneció, los médicos lo llevaron en una ambulancia al Heca. Murió a las 23.

En la vereda habían quedado Ileana, sus padres y sus hijos con los vecinos y familiares de la ex pareja. Ramiro se subió al auto y se fue. El padre de Martín se acercó corriendo, le pegó a Ileana y la amenazó, contó la mujer en el juicio, donde agregó que era víctima de golpes constantes por parte de Martín.

Ramiro Pehuel L., entonces de 28 años, fue apresado a los cuatro días en una vivienda de la Villa La Bombacha. El 8 de abril de 2016 el juez de Sentencia N° 6, Ismael Manfrín, lo absolvió por legítima defensa del delito de homicidio simple.

El dictamen de Manfrín fue apelado por el abogado querellante, Eduardo Mario Sosa, quien representa a la familia de Prado, y también por la fiscalía: ambas partes sostuvieron un homicidio agravado. Fue en ese marco que la causa fue revisada por la Cámara Penal, integrada por los jueces Guillermo Llaudet (quien fundamentó el primer voto), Carina Lurati y Carolina Hernández, que ratificó la resolución de primera instancia. Esta última magistrada votó en disidencia al considerar que “no se advierte en el caso una proporcionalidad entre la conducta agresiva y la conducta defensiva en cuanto a su lesividad”. Por lo tanto, pidió que el caso fuera devuelto a otro juez para un nuevo fallo. Pero su postura quedó en minoría.

    • It appears to me that this is a key aspect of the 2030 initiative ideology. While the Rothschilds were indeed influential individuals who were able to sway governments, much like present-day billionaires, the true impetus for change stems from the omnipotent forces (Satan) shaping our world. In this case, there is a false God of this world. However, what drives action within a political framework? Power! What is unfolding before our eyes in today's world? The relentless struggle for power. The overwhelming tide of people rising. We cannot underestimate the direct and sinister influence of Satan in all of this. However, it is up to individuals to decide how they choose to worship God. Satanism, as a form of religion, cannot be regarded as a true religion. Consequently, just as ancient practices of child sacrifice had a place in God's world, such sacrifices would never be accepted by the True God of our universe. Despite the promising 2030 initiative for those involved, it is unfortunately disintegrating due to the actions of certain individuals in positions of authority. What kind of sacrifice does Satan accept with the death of babies and children in places like Gaza, Ukraine, and other conflicts around the world, whether in the past or present, that God wouldn't? Whatever personal experiences we may have had with well-known individuals, true Christians understand that current events were foretold long ago, and nothing can prevent them from unfolding. What we are witnessing is the result of Satan's wrath upon humanity, as was predicted. A true religion will not involve itself in the politics of this world, as it is aware of the many detrimental factors associated with such engagement. It understands the true intentions of Satan for this world and wisely chooses to stay unaffected by them.
    • This idea that Satan can put Jews in power implies that God doesn't want Jews in power. But that would also imply that God only wants "Christians" including Hitler, Biden, Pol Pot, Chiang Kai-Shek, etc. 
    • @Mic Drop, I don't buy it. I watched the movie. It has all the hallmarks of the anti-semitic tropes that began to rise precipitously on social media during the last few years - pre-current-Gaza-war. And it has similarities to the same anti-semitic tropes that began to rise in Europe in the 900's to 1100's. It was back in the 500s AD/CE that many Khazars failed to take or keep land they fought for around what's now Ukraine and southern Russia. Khazars with a view to regaining power were still being driven out into the 900's. And therefore they migrated to what's now called Eastern Europe. It's also true that many of their groups converted to Judaism after settling in Eastern Europe. It's possibly also true that they could be hired as mercenaries even after their own designs on empire had dwindled.  But I think the film takes advantage of the fact that so few historical records have ever been considered reliable by the West when it comes to these regions. So it's easy to fill the vacuum with some very old antisemitic claims, fables, rumors, etc..  The mention of Eisenhower in the movie was kind of a giveaway, too. It's like, Oh NO! The United States had a Jew in power once. How on earth could THAT have happened? Could it be . . . SATAN??" Trying to tie a connection back to Babylonian Child Sacrifice Black Magick, Secret Satanism, and Baal worship has long been a trope for those who need to think that no Jews like the Rothschilds and Eisenhowers (????) etc would not have been able to get into power in otherwise "Christian" nations without help from Satan.    Does child sacrifice actually work to gain power?? Does drinking blood? Does pedophilia??? (also mentioned in the movie) Yes, it's an evil world and many people have evil ideologies based on greed and lust and ego. But how exactly does child sacrifice or pedophilia or drinking blood produce a more powerful nation or cabal of some kind? To me that's a giveaway that the authors know that the appeal will be to people who don't really care about actual historical evidence. Also, the author(s) of the video proved that they have not done much homework, but are just trying to fill that supposed knowledge gap by grasping at old paranoid and prejudicial premises. (BTW, my mother and grandmother, in 1941 and 1942, sat next to Dwight Eisenhower's mother at an assembly of Jehovah's Witnesses. The Eisenhower family had been involved in a couple of "Christian" religions and a couple of them associated with IBSA and JWs for many years.)
