Ciudad de México.- Un juez federal ordenó que una menor, quién profesa la religión Testigos de Jehová, enferma de leucemia reciba una transfusión de sangre siempre y cuando hayan intentado con todos los tratamientos alternativos; la decisión fue tomada en base a los derechos de libertad de creencia y religión con el derecho humano a la vida.

El titular del juzgado Octavo del estado de Chihuahua, Mauricio Fernández de la Mora, concedió un amparo a una mujer rarámuri perteneciente a la religión Testigos de Jehová para que su hija enferma de leucemia pueda recibir una transfusión de sangre, acción que no aceptan los creyentes de dicha religión.

Para llegar a esta decisión se revisaron los derechos de vida y libertad de creencias, consentimiento informado y toma de decisiones, respecto a tratamientos médicos; pero se le dio mayor peso a que la niña aún no es capaz de comprender las decisiones médicas sobre su salud y se privilegió el derecho a la vida.

Además en el comunicado se informa que se instó a los tres poderes del Estado de Chihuahua, para que se realicen las reformas correspondientes para la creación de un protocolo y procedimiento para que los doctores, en caso de la negativa del consentimiento de los padres para administrar tratamientos a menores, en lugar de acudir a la Subprocuraduría del Menor, se presenten ante un juez de lo familiar para argumentar el caso, y que sea ese juzgador quien analice las circunstancias.

Ordena juez aplicar transfusión a niña Testigo de Jehová con leucemia

Un juez federal ordenó que una niña de cinco años de edad, enferma de leucemia, reciba una transfusión de sangre, una vez que se hayan agotado los tratamientos médicos alternativos, en virtud de que profesa la religión Testigos de Jehová.

El juez Mauricio Fernández de la Mora, titular del Juzgado Octavo de Distrito en el estado de Chihuahua, concedió el amparo a una mujer de la etnia rarámuri, que profesa aquella religión, para que se transfunda sangre a su hija menor de edad, afectada por leucemia, siempre y cuando se hayan agotado otros medios o tratamientos alternativos, como los que propusieran diversos médicos, incluyendo oncólogos del Centro de Cancerología de Chihuahua.

El Consejo de la Judicatura Federal (CJF), en una nota informativa, señaló lo anterior y sostuvo que el juez federal, luego de ponderar los derechos de libertad de creencia y religión con el derecho humano a la vida, asumió dicha resolución.

En la sentencia se revisó el derecho fundamental de libertad de creencia y religión, así como los derechos a una segunda opinión, consentimiento informado y toma de decisiones, respecto a tratamientos médicos.

Sin embargo, debido a la falta de madurez de la niña para comprender el alcance del acto médico sobre su salud, se privilegió el derecho a la vida; por lo que en caso de ser necesario, se autorizó a los médicos a realizar los tratamientos necesarios para proteger la vida de la menor, incluyendo la transfusión sanguínea.También se determinó como discriminatoria e ilegal la tutela que asumió la Subprocuraduría del Menor, debido a la falta de consentimiento por parte de la quejosa para autorizar la transfusión de sangre a su hija.

En consecuencia, para evitar que se repitan actuaciones arbitrarias, discriminatorias y denigrantes hacia padres de familia, se dio vista a los tres poderes del estado de Chihuahua, para que se realicen las reformas correspondientes para la creación de un protocolo y procedimiento para que los doctores, en caso de la negativa del consentimiento de los padres para administrar tratamientos a menores, en lugar de acudir a dicha Subprocuraduría, se presenten ante un juez de lo familiar para argumentar el caso, y que sea ese juzgador quien analice las circunstancias, escuche a las partes y resuelva lo correspondiente.

Dentro de la Ciencia Jurídica, la tutela del derecho a la vida es principio clave para el ejercicio de los demás derechos. Sin embargo, en ocasiones, el derecho a la vida colisiona con otros derechos, como por ejemplo cuando hablamos de la pena de muerte como medida extrema de control por parte del Estado para combatir el crimen y sus manifestaciones.

Durante las últimas décadas el derecho a la vida se ha estudiado por los Tribunales en México con motivo de los casos por la despenalización del aborto en la CDMX, y por el polémico caso de la eutanasia.

Ahora bien, en recientes fechas se registró un precedente muy interesante en el que se ponderó el derecho a la libertad de creencia y el derecho a la vida. En este asunto, una niña de cinco años desarrolla leucemia, por lo cual su madre acude a un hospital para su debida atención y tratamientos, entre los que incluyen las transfusiones de sangre.

Cabe señalar que la mujer pertenece a la etnia Rarámuri y profesa la religión Testigos de Jehová por lo cual sus creencias religiosas prohíben la práctica de transfusiones de sangre.  En consecuencia, la madre no consintió la transfusión.

En virtud de lo cual el departamento de trabajo social del hospital reportó el hecho ante la Subprocuraduría del Menor de Chihuahua, quien ordenó el tratamiento. En razón de ello, la madre promovió un juicio de amparo para evitar que se transfunda sangre a su hija.

En la resolución, el juez de Distrito revisó el derecho fundamental de libertad de creencia y religión, así como los derechos a una segunda opinión, consentimiento informado y toma de decisiones, respecto a tratamientos médicos, con lo cual resolvió amparar a la madre para el efecto de que la niña no sea transfundida sin antes agotarse otros medios o tratamientos alternativos, como los que propusieran diversos médicos, incluyendo oncólogos del Centro de Cancerología de Chihuahua, a fin de preservar la vida de la menor.

    • It appears to me that this is a key aspect of the 2030 initiative ideology. While the Rothschilds were indeed influential individuals who were able to sway governments, much like present-day billionaires, the true impetus for change stems from the omnipotent forces (Satan) shaping our world. What kind of sacrifice does Satan accept with the death of babies and children in places like Gaza, Ukraine, and other conflicts around the world, whether in the past or present, that God wouldn't? Whatever personal experiences we may have had with well-known individuals, true Christians understand that current events were foretold long ago, and nothing can prevent them from unfolding. What we are witnessing is the result of Satan's wrath upon humanity, as was predicted. A true religion will not involve itself in the politics of this world, as it is aware of the many detrimental factors associated with such engagement. It understands the true intentions of Satan for this world and wisely chooses to stay unaffected by them.
    • This idea that Satan can put Jews in power implies that God doesn't want Jews in power. But that would also imply that God only wants "Christians" including Hitler, Biden, Pol Pot, Chiang Kai-Shek, etc. 
    • @Mic Drop, I don't buy it. I watched the movie. It has all the hallmarks of the anti-semitic tropes that began to rise precipitously on social media during the last few years - pre-current-Gaza-war. And it has similarities to the same anti-semitic tropes that began to rise in Europe in the 900's to 1100's. It was back in the 500s AD/CE that many Khazars failed to take or keep land they fought for around what's now Ukraine and southern Russia. Khazars with a view to regaining power were still being driven out into the 900's. And therefore they migrated to what's now called Eastern Europe. It's also true that many of their groups converted to Judaism after settling in Eastern Europe. It's possibly also true that they could be hired as mercenaries even after their own designs on empire had dwindled.  But I think the film takes advantage of the fact that so few historical records have ever been considered reliable by the West when it comes to these regions. So it's easy to fill the vacuum with some very old antisemitic claims, fables, rumors, etc..  The mention of Eisenhower in the movie was kind of a giveaway, too. It's like, Oh NO! The United States had a Jew in power once. How on earth could THAT have happened? Could it be . . . SATAN??" Trying to tie a connection back to Babylonian Child Sacrifice Black Magick, Secret Satanism, and Baal worship has long been a trope for those who need to think that no Jews like the Rothschilds and Eisenhowers (????) etc would not have been able to get into power in otherwise "Christian" nations without help from Satan.    Does child sacrifice actually work to gain power?? Does drinking blood? Does pedophilia??? (also mentioned in the movie) Yes, it's an evil world and many people have evil ideologies based on greed and lust and ego. But how exactly does child sacrifice or pedophilia or drinking blood produce a more powerful nation or cabal of some kind? To me that's a giveaway that the authors know that the appeal will be to people who don't really care about actual historical evidence. Also, the author(s) of the video proved that they have not done much homework, but are just trying to fill that supposed knowledge gap by grasping at old paranoid and prejudicial premises. (BTW, my mother and grandmother, in 1941 and 1942, sat next to Dwight Eisenhower's mother at an assembly of Jehovah's Witnesses. The Eisenhower family had been involved in a couple of "Christian" religions and a couple of them associated with IBSA and JWs for many years.)
