MÉXICO  – La Suprema Corte de Justicia estableció, por primera vez, que el Estado puede autorizar tratamiento médico urgente a un menor gravemente enfermo, aunque sus padres lo rechacen por sus creencias religiosas.

La Primera Sala de la Corte avaló la intervención de autoridades de Chihuahua para ordenar transfusiones de sangre a una niña con leucemia, cuyos padres son Testigos de Jehová.

“El Estado puede interferir válidamente en la autonomía parental para tomar decisiones por los padres cuando la decisión de los progenitores ponga en riesgo la vida o la salud de sus hijos”, afirmó la Sala, al aprobar por cuatro votos contra uno un proyecto del Ministro Arturo Zaldívar.

En abril de 2017, la niña de 6 años, de nombre Saraí, fue diagnosticada con leucemia linfoblástica aguda en el Hospital Infantil de Especialidades de Chihuahua, pero los padres pidieron un tratamiento sin transfusiones.

La Subprocuraduría inició un procedimiento de protección y autorizó el tratamiento y quimioterapia. Esto motivó a que la madre presentara un amparo.

En primera instancia, el entonces juez Mauricio Fernández de la Mora reprobó la actuación de las autoridades de Chihuahua y las acusó de discriminar a los padres de la niña, que son indígenas rarámuris, pero la Corte revocó esta sentencia.
